1.1 This website (https://australianvintners.co.uk/) (the “Website”) is operated by Australian Vintners Limited (“we”, “us”, or “our”).
1.2 We are a limited company registered in England and Wales under company number 15091305. Our registered office is: 2nd Floor, One Hobbs House, Harrovian Business Village, Bessborough Road, Harrow, HA1 3EX.
1.3 Our contact email address is wine@australianvintners.co.uk. These Terms and Conditions (“Terms”) apply to every order placed through the Website. By placing an order, you agree to be bound by them.
1.4 These Terms do not affect your statutory rights as a consumer under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
2.1 Under the Licensing Act 2003, it is a criminal offence to sell alcohol to anyone under the age of 18, or to purchase or attempt to purchase alcohol on behalf of anyone under the age of 18.
2.2 By using the Website and placing an order, you confirm and warrant that you are at least 18 years of age.
2.3 If you are purchasing wine as a gift, you confirm that the intended recipient is also at least 18 years of age. It is your responsibility to ensure this is the case.
2.4 We operate a strict Challenge 25 policy. Our delivery partners will require proof of age (a valid passport, photo driving licence, or PASS-accredited ID card) if the person receiving the delivery appears to be under 25. If valid ID cannot be provided, delivery will be refused and the order returned to us. We are not liable for any inconvenience, cost, or delay arising from a failed age-verification check.
2.5 We reserve the right to cancel or refuse any order where we reasonably suspect it is being placed by, or on behalf of, a person under 18.
3.1 Placing an order through our checkout is an offer by you to purchase the goods, not an acceptance by us.
3.2 A legally binding contract is formed only when we dispatch your order and send you a shipping confirmation email. Any order confirmation or acknowledgement sent before dispatch does not constitute acceptance.
3.3 We reserve the right to decline or cancel any order at our discretion, including (without limitation) where: a product is out of stock, a pricing or product description error has occurred, payment is declined or suspected to be fraudulent, or age-verification cannot be confirmed. Where we decline or cancel an order after payment has been taken, we will issue a full refund without delay.
3.4 If a product you have ordered becomes unavailable after you order but before dispatch, we will contact you to offer a substitute, a delay, or a full refund. We will not substitute a product without your agreement.
4.1 All prices listed on the Website are in GBP (£) and are inclusive of UK VAT at the standard rate and any applicable UK alcohol duty, unless stated otherwise.
4.2 Prices do not include delivery charges, which are calculated and displayed at checkout before you complete your order.
4.3 While we take reasonable care to ensure prices and product descriptions are accurate, errors may occasionally occur. If we discover a pricing or description error in an order you have placed, we will contact you before dispatch to confirm whether you wish to proceed at the correct price, and you may cancel the order for a full refund if you do not.
4.4 Payment is taken at the time of ordering. We accept payment via Visa, Mastercard, American Express, Apple Pay, Google Pay, and PayPal, processed securely through our payment processors
5.1 We deliver exclusively to addresses within the United Kingdom.
5.2 We aim to deliver on the next working day for orders placed before 11am Monday to Thursday. Orders placed after this time, or over a weekend or bank holiday, will be processed on the next working day. Delivery estimates are not guaranteed delivery dates.
5.3 Time of delivery is not of the essence. We are not liable for delays caused by our courier partners, incorrect delivery information provided by you, or events beyond our reasonable control (see clause 9).
5.4 Someone aged 18 or over must be present to receive and sign for the delivery and to provide ID if requested. If no eligible person is available, the courier may leave a card and arrange redelivery or collection; we are not liable for any resulting delay.
5.5 Risk in the goods passes to you on delivery. Title to the goods passes to you once full payment has been received.
6.1 In accordance with the Consumer Contracts Regulations 2013, you have the right to cancel your order for any reason within 14 days of receiving the goods, and a further 14 days to return them once you have told us you wish to cancel.
6.2 To cancel, contact us by email at wine@australianvintners.co.uk with your order number and a clear statement that you wish to cancel. You may use the model cancellation wording: “I/We hereby give notice that I/We cancel my/our contract of sale of the following goods [order number / description], ordered on [date], received on [date].”
6.3 To qualify for a full refund under this right, returned bottles must be unopened, sealed, undamaged, and in their original packaging. This condition does not apply to bottles that are faulty, damaged in transit, or sent in error — see clause 6.5.
6.4 Unless the goods are faulty, damaged on arrival, or sent in error, you are responsible for the cost and risk of returning the items to us in line with clause 6.3.
6.5 If a bottle is corked, otherwise faulty, or damaged in transit, please contact us within 5 working days of delivery with photographic evidence. We will arrange a replacement or full refund, including any applicable return postage, at no cost to you. This is in addition to, and does not affect, your statutory rights under the Consumer Rights Act 2015 in respect of goods that are not of satisfactory quality, fit for purpose, or as described.
6.6 Refunds will be issued to your original payment method within 14 days of us receiving the returned goods, or of you providing evidence of return postage, whichever is earlier.
7.1 Wine is a natural, small-batch product. The vintage, label design, exact alcohol by volume (ABV), and precise tasting characteristics of a wine may vary slightly from the images, vintages, or descriptions shown on the Website due to producer stock changes, regulatory labelling requirements, or natural variation between bottlings.
7.2 Tasting notes, food-pairing suggestions, and scores published on the Website are provided for general guidance and reflect our own or third-party opinions; they are not a guarantee of taste, quality, or suitability for any particular purpose.
8.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under English law.
8.2 Subject to clause 8.1, our total liability to you arising out of or in connection with any order, whether in contract, tort (including negligence), or otherwise, shall not exceed the total price paid for the order giving rise to the claim.
8.3 Subject to clause 8.1, we shall not be liable for any indirect, special, or consequential loss, including loss of profit, loss of business, or loss of opportunity, arising from your use of the Website or any order placed through it.
8.4 We supply goods for domestic and private use. If you use the goods for any commercial, business, or resale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
9.1 We will not be liable for any failure or delay in performing our obligations where this is caused by circumstances beyond our reasonable control, including but not limited to adverse weather, strikes, courier or supply chain disruption, or governmental action. If such an event continues for more than 30 days, either party may cancel the affected order and any payment made will be refunded.
10.1 All content on the Website, including tasting notes, text, graphics, logos, and images, is owned by Australian Vintners Limited or our producer partners and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or reuse any content from the Website without our prior written consent.
10.2 You agree to use the Website only for lawful purposes and not to attempt to gain unauthorised access to any part of it, or to use it in a way that could damage, disable, or impair its operation.
11.1 Our collection and use of your personal data is set out in our separate Privacy Policy. Our use of cookies is set out in our Cookie Policy. By using the Website, you consent to data processing in line with those policies.

13.1 If you have a complaint about your order or about the Website, please contact us at wine@australianvintners.co.uk and we will aim to acknowledge it within 2 working days and resolve it as quickly as possible.
14.1 We may update these Terms from time to time to reflect changes in our practices or in the law. The version of the Terms in force at the time you place an order will apply to that order. The current version will always be available on the Website.
15.1 If any provision of these Terms is found by a court or regulator to be unlawful or unenforceable, the remaining provisions will continue in full force and effect.
15.2 These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us in relation to your use of the Website and purchase of goods.
16.1 These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, save that if you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
